Engineers Registration

Yes, previous Original Registration Certificate is mandatory for endorsement whether it was expired.

In case of loss of Original Certificate following documents are required:-

  • Copy of FIR (Must contain name of engineer and PEC registration number)

Yes, Engineer can endorse more than one qualification except the degree is not acquired under Distance Learning Qualification.

HEC Attested degree is not compulsory for endorsement; but if attested, then verification will not be carried out by PEC.

Distance Learning is not recognized by PEC; therefore, not endorsed.

Rs: 5500/- fee is required for Professional Engineer.

Competency profile submission is mandatory for interview as PE so that panel of experts can assess engineers’ competency through his area of expertis and project details.

For elevation of title from RE to PE, An Engineers needs to return back his RE certificate so that new PE certificate will be issued.

  • He/She must be graduated after April 2005.
  • Must be registered as R.E with PEC.

It is result notification of graduates sent by HEIs to PEC.

“Registered Engineer” means a person who holds an accredited engineering qualification, whether working privately or in the employment of an engineering public organization and is registered as such by the Council. Registered Engineer shall perform all professional engineering works except independently signing design.

“Professional Engineer” means a person who holds an accredited engineering qualification and after obtaining a professional experience of five years, whether working privately or in the employment of an engineering public organization, has passed the prescribed engineering practice examination and is registered as such by the Council.

A newly graduate is registered with PEC as Registered Engineer. A Registered Engineer can become Professional Engineer after completing five years’ experience and passing engineering practice examination (EPE).

An engineer cannot undertake any professional engineering works unless registered with PEC. Therefore  registration with PEC is mandatory.

The qualification of B.Tech is not equivalent to Bachelor of engineering. Therefore PEC does not register them as such. PEC registers only such graduates who possess engineering qualification duly accredited with PEC.

There is no difference. There are different nomenclatures which are used by different Engineering universities.

After the expiry of Renewal Card, engineer has to apply for issuance of renewal card for any number of years not exceeding three at a time.

Application for renewal can be submitted online using Web portal along with scan copies of the required documents.

A Professional Engineer who has attained the age of sixty years and is unemployed shall be exempted from the payment of annual renewal fee for the rest of his life and his Renewal Card shall be issued upon his request.

Renewal Procedure for Non-Resident Pakistanis Registered Engineers and
Professional Engineers is same as those of resident Pakistanis Registered Engineers
and Professional Engineers respectively.

Two choices for Renewal are available for RE & PE i.e. yearly basis renewal and life time subscription.

Engineers who have paid lifetime subscription are also required to obtain renewal cards by following the renewal procedure after expiry on “NO CHARGE BASIS”. It means they are not required to pay any fee/cost for renewal purpose. However they have to renew his/her registration after expiry.

When a Registered Engineer has attained a minimum of five years of practical experience in relevant field of engineering from a recognized engineering organization or institution or service and has earned at least seventeen CPD credit points, he / she shall become eligible to apply for Engineering Practice Examination (EPE) on the form available in CPD Section, which is for the assessment of the engineering competence,
knowledge and skills of an applicant engineer.
A Registered Engineer may qualify for registration as Professional Engineer after qualifying the EPE, which may be arranged and conducted through local or foreign services hired or availed for the purpose.

CPD

Continuing Professional Development (CPD) is the means by which members of professional bodies maintain, improve and broaden their knowledge and skills for developing personal qualities required in their professional lives.
Pakistan Engineering Council under its Act has mandate for introducing and ensuring continued professional development activities amongst its growing community of engineers and has devised a comprehensive framework titled Professional Development of Engineers (Bye Laws – 2008) approved by the Government of Pakistan.

For newly Registered Engineer, first year after graduation shall be a grace period and CPD will be applicable from second year onwards. A Registered Engineer shall have to earn nine credit points in first three years cycle, twelve credit points in the next three years cycle and five credit points per year thereafter for renewal of registration as per CPD Bye Laws

CPD is mandatory for Professional Engineers (PE), either newly registered or already registered required to obtain three credit points per year for the renewal of the registration, with effect from July 2010.

PEC is conducting CPD activities through Zoom video link, engineer can get registered for online CPD course through PEC official Facebook page (https://www.facebook.com/PECOfficial). Further, complete online CPD activities are also uploaded on PEC website.

It is an examination conducted by PEC for registered engineers to grant them the status of professional engineer which is conducted twice a year. It consist of following parts:

  1. Part-I: Common for all Engineering Disciplines.
  2. Part-II: Based on breadth and depth subjects of specific engineering discipline.

Candidate has to secure at least 60 % marks in each part to qualify the exam. Further, if candidate fails any of the exam part then he/ she has to pass the failed part only in three consecutive attempts.

A registered engineer with job experience of five (05) years and having 17 CPD points since 10th July 2010 is eligible to appear in EPE exam.

After announcement of EPE examination schedule through advertisement by PEC, eligible register engineer can apply for EPE examination through hard form available at PEC official website, along with all required documents mentioned on application form.

The EPE is optional for a Registered Engineer but is an essential part to obtain the title of Professional Engineer. However, those graduates who were registered with PEC before March 31, 2005 are titled as PE and if any of them now apply for registration, they have to appear for interview before PEC Enrollment Committee.

Engineering Practice Exam (EPE) Fee is Rs 5,000 + bank charges for New Candidates and Rs 2,500 + bank charges for candidates re-appearing in one part.

Accreditation

Engineering qualification/ program accreditation is the process of peer review assessment process to verify imparting of quality education as per PEC laid down policy/ criteria (PEC Accreditation Manual – 2019 guidelines).

An Engineering qualification as accredited/ recognized by PEC and included in the First Schedule or Second Schedule of PEC Act 1976.

Engineering qualifications accredited under Level-II of First Schedule of PEC Act 1976 are considered as substantially equivalent under Washington Accord.

Minimum Qualification for admission to engineering Bachelor’s degree programs offered by Engineering Institutions and Universities are mentioned in PEC Regulations for Engineering Education in Pakistan, under Article-2(a)(i)(ii)(b)(c)(d):

 

A candidate seeking admission in an Engineering Institution/University for working towards Bachelor’s Degree in any recognized branch of Engineering must fulfill the following minimum requirements:─ (a) (i) He or she has passed the Higher Secondary School Certificate (HSC/HSSC) Pre-Engineering Examination with Physics, Chemistry and Mathematics, securing at least 60% marks in aggregate of a University, a Board of Intermediate or Board of Intermediate and Secondary Education in Pakistan. In addition, a combination of Physics, Mathematics and Computer Studies/Computer Science may be allowed for admissions in all Computer related Engineering Programmes, Electronics, Telecommunications and Avionics Engineering Programmes and a combination of Biology, Physics, Chemistry may also be allowed for Bio-Medical or Bio-Engineering.

An updated list of DAEs is available/ uploaded on PEC website to see the relevancy of DAE for admission in engineering program. Admission of the student may be cancelled if not relevant to the engineering program.

The deadline for request for Zero Visit to launch a new engineering program to PEC is January 31 of the same year.

The deadline for Interim Visit is before the end of 4th Semester of first approved intake.

By October of each year for the graduating batch in the succeeding year.

By March of the same year in which changes are required to be implemented in the program.

Migration cases be reported within same semester to PEC. NOC be also obtained in light of Artcle-3(d) of PEC Regulations for Engineering Education in Pakistan.

A candidate seeking admission in an Engineering Institution/ University for working towards Bachelor’s degree in any recognized branch of Engineering must fulfill the minimum requirements of PEC Regulations, Article-2(c)(i)(ii). Without above, the admission of the student may be cancelled when reported/ found illegal.

 

Article 2c(ii)

A candidate who has passed the Diploma of Associate Engineer (DAE) Examination, securing at least 60% aggregate marks shall be eligible for applying in admission on open merit in relevant discipline of Engineering in which he or she has passed the DAE examination; and the relevancy of DAE will be as determined by Accreditation Committee of this Council;

 

Article 2c(ii)

A candidate possessing four years degree/ qualification of B.Tech (Hons)/ B.S/ B.Sc./ Bachelor of Technology (with relevant discipline) or equivalent qualification duly recognized by HEC seeking admission towards the relevant engineering discipline against 02% reserved seats of B.Tech (Hons)/ B.S/ B.Sc./ Bachelor of Technology (with relevant discipline), shall be considered for admission in 2021 and after; with two years of exemption subject to assessment of courses by concerned HEI studied for allowing maximum 40 credit hours transfer and satisfying PEC Regulations, and where needed qualifying remedial courses, shall be eligible for registration with the Council as per laid down criteria:

 

          Provided that a candidate possessing above qualifications, enrolled against the reserved seats during the period January 2015 to December 2020 shall be considered for one year exemption, and;

 

          Candidates possessing B.Tech (Pass) and B.Tech (Hons) or equivalent qualifications, enrolled up to 31st December, 2014 shall be considered for exemption of one and two years, respectively.

5% seats over and above the allowed intake for government nominees including religious minorities in Public Sector Universities/ Institutions subject to approval from PEC. If HEIs desire to admit more students, then may apply for change of scope (increase in intake) to ensure the quality and standards.

The HEI must submit Intake data provisionally within one month of admission and final data should be shared at the end of 1st Semester. Further, the penalty policy would intact in case of violation as per Article-8 of PEC Regulations including procedural penalties.

Bidding Documents

The “Criteria and Procedure for Incorporation of Price Adjustment Provisions in the On-Going Contracts, August 2022”, mentions the Employer and the Contractor as contracting parties. As such, this procedure may also be used for ongoing Projects in private Sector, in addition to Public Sector projects.

PEC is a Statutory Regulator for Engineering profession established under Pakistan Engineering Council Act 1976, amended from time to time. Section 8(p) of PEC Act 1976 vests in PEC the authority to establish standards for engineering contracts, cost and services. Therefore, any document issued by PEC (and not bearing word DRAFT in its Heading and/ or embedded as watermark) does carry force of Delegated Legislation (law). Issuance of any notification in such regard is the choice of the Regulator.

 

The question is related to para (iii) of Sub-Section 1.2.1 [Fixed Price Contracts/ Contracts without Price Adjustment Clause]. In this provision, it has been considered that a qualified and experienced Constructor does include a price escalation risk margin (typically 10%) in his bid against a Fixed Price Bid. The crux of the provision is that any escalation exceeding 10% shall be payable to the Contractor. Accordingly, in case escalation is less than 10%, there will be no price adjustment.

The term “Ongoing” clarifies everything. Whether a project is ongoing or not depends on the terms of the Contract Document agreed and duly signed between the Parties and/ or departmental codal requirements such as compliance with General Financial Rules (GFRs), etc. Since the Price Adjustment for Ongoing Projects is to be enforced through amendment to the Contract duly signed between the Parties, the Contract Administrator has to consider whether an amendment to the Contract is possible or not.

Section 2 [Mode of Payment of the Determined Price Adjustment] of “Criteria and Procedure for Incorporation of Price Adjustment Provisions in the On-Going Contracts, August 2022, clearly lays down the procedure for payment of the Price Adjustment for only the Works that are ongoing. In other words it defines the scope for applicability of the Price Adjustment and is not a flaw by itself.

Therefore, if the project is ongoing and the present stage allows an amendment to the Contract, The Price Adjustment for Ongoing Projects, of August 2022 shall apply.

Item 1 of Section B [OBJECTIVES] of the chapter “INSTRUCTIONS TO USERS” of the “STANDARD PROCEDURE AND FORMULA FOR PRICE ADJUSTMENT (Second Edition), MAY 2022”, defines the price adjustment as “a reasonable compensation against variation in prices of the selected materials and inputs, as close as possible to the actual”.

Accordingly, Item 1 of Section B [PARAMETERS], limits the cost elements for price adjustment to those having cost impact of three (03) percent or higher; the only exceptions being POL and Labour.

  1. The amount of Cash Advance Bank Guarantee (hereinafter called Bank Guarantee) is equal to the difference of total Price Adjustment and the Price Adjustment payable to date in terms of Section 2(i)(c) of the “Criteria and Procedure for Incorporation of Price Adjustment Provisions in the On-Going Contracts, August 2022. In other words, the Amount of Bank Guarantee shall be equal to the price adjustment which was to be paid in installments in future, but has been completely paid as per request of the Contractor. Such amount becomes a cash advance and Cash Advance Bank Guarantee shall be applicable.
  2. Section 2(i)(c) of the “Criteria and Procedure for Incorporation of Price Adjustment Provisions in the On-Going Contracts, August 2022 has specified the Validity of the Cash Advance Bank Guarantee as 28 days after the issuance of Taking Over Certificate; provided the advance payment has been completely repaid by the Contractor.
  3. “Reducing Bank Guarantee” is a cash advance security in the form of an unconditional bank guarantee, the secured amount of which is progressively reduced by the amount of the advance payment repaid by the Contractor or adjusted by the Employer, indicated in the reconciled adavance statement, jointly agreed by both the Employer and the Contractor, typically on quarterly basis.

The SPFPA May 2022, Clause A-10 is applicable “For imported Plant/equipment and materials quoted in local currency”, as per stated item in BOQ.

Regarding this question, para (ii) of Sub-Section 1.2.2 of the “Criteria and Procedure for Incorporation of Price Adjustment Provisions in the On-Going Contracts, August 2022”, are applicable, which provision is quite clear. There are three periods for calculation of the amount of Price Adjustment, as under:

  • Up to30-12-2020: The amount of Price Adjustment shall be computed on the basis of the formula for Price Adjustment (if any) included in Contract.
  • From 01-01-2021 to the last Paid IPC: The contractor shall be eligible to receive the difference between the amounts calculated by “Criteria and Procedure for Incorporation of Price Adjustment Provisions in the On-Going Contracts, August 2022”, and the formula for Price Adjustment (if any) included in Contract, if already paid up to the last Paid IPC.

From the last Paid IPC: According to the “Criteria and Procedure for Incorporation of Price Adjustment Provisions in the On-Going Contracts, August 2022”, up to Final IPC or cessation of the “Criteria and Procedure for Incorporation of Price Adjustment Provisions in the On-Going Contracts, August 2022” in accordance with part (ii) of Section 2 thereof; whichever occurs earlier.

Revision of PC-I is an administrative issue and has to be undertaken departmentally. PEC has advised a revision in PC-I, if required, in order to emphasize that the issuance of any such Price Adjustment Procedure by PEC does not absolve a Public Sector Procuring Agency from fulfilling its basic/ codal formalities.

In case departmental codal formalities do not warrant revision in PC-I, it may be dealt with accordingly. However, in case departmental rules require revision in PC-I and any further documentation/ approvals, these shall be complied with.

It may be noted that replies to specific questions that may lead to contract administration do not fall under the purview of FAQs.

However, it is elaborated that the provision requires certain tasks to be performed by the “Special Cells”; which condition shall be satisfied in any case.

Delay analyses is performed to process a request of the Contractor for determination of Extension of Time (EoT).

Sub-Section 1(1.1) (iii) of the “Criteria and Procedure for Incorporation of Price Adjustment Provisions in The On-Going Contracts August 2022 Document” provides that the Price Adjustment shall be worked out as per “STANDARD PROCEDURE AND FORMULA FOR PRICE ADJUSTMENT (Second Edition), MAY 2022” (SPFPA May 2022).

Section A(3) of Part-I of the SPFPA May 2022 is applicable to a project where time for completion has been exceeded. It addresses all the scenarios of the Price Adjustment for the period beyond the scheduled completion period.
